These Terms of Service (“Terms”) govern your use of evryday.wtf and any purchase you make on it (the “Platform”). The Platform is owned and operated by Witness the Fitness Pvt. Ltd., A Block, Sector 9, Noida, Uttar Pradesh 201301, India (“EVRYDAY”, “we”, “us”, “our”). EVRYDAY is a brand of WTF (Witness the Fitness). By using the Platform or placing an order, you agree to these Terms, our Privacy Policy, Refund & Return Policy and Shipping Policy. These Terms are an electronic record under the Information Technology Act, 2000 and do not need a signature.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract under Indian law. If you are under 18, you may use the Platform only with the involvement of a parent or legal guardian. We may refuse service or suspend access to anyone who breaches these Terms.

2. Your account

  • You may need to verify your phone number or email (for example by OTP) to place an order or use your account.
  • You are responsible for keeping your login details safe and for all activity on your account. Tell us immediately if you suspect unauthorised use.
  • Please give accurate name, address and contact details so we can deliver your order.

3. Products and information

  • EVRYDAY products are health supplements and food products. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease.
  • Always read the label, recommended usage, allergen information and warnings before use. Consult a qualified medical professional before use if you are pregnant, breastfeeding, under 18, taking medication or have a medical condition. Products containing caffeine are not recommended for children, pregnant or breastfeeding women, or people sensitive to caffeine.
  • We try to show product details, images and colours accurately. Images may be illustrative, and photos of people on the Platform are illustrative. The label on the product you receive is the final source of product information.

4. Orders and acceptance

  • Placing an order is an offer to buy. A contract is formed only when we confirm and dispatch your order.
  • We may limit quantities, or refuse or cancel an order, for reasons including stock unavailability, a pricing or listing error, suspected fraud or misuse, an unserviceable address, or a legal or safety reason. If you have paid for a cancelled order, we refund you in full.

5. Prices and payment

  • All prices are in Indian Rupees (₹) and include applicable taxes unless stated otherwise. Shipping and any other charges are shown at checkout before you pay.
  • Prices and offers may change without notice. The price applicable to your order is the one shown at checkout when you place it.
  • Payments are processed by our payment partners (such as Cashfree) using secure systems. We do not store your full card or bank details.
  • Cash on Delivery is available on eligible orders and PIN codes and may require OTP or call confirmation.

6. Offers, coupons and promotions

Coupons, discounts and promotions are subject to their stated terms, validity and usage limits, cannot be exchanged for cash, and may be withdrawn at any time. We may cancel orders or benefits obtained through misuse, multiple accounts or fraud.

7. Shipping, cancellation, returns and refunds

Delivery is covered by our Shipping Policy. Cancellations, replacements and refunds are covered by our Refund & Return Policy. In short: you can cancel before dispatch; opened supplements cannot be returned for change of mind; damaged, wrong, missing or expired items reported within 7 days of delivery are replaced or refunded.

8. Acceptable use

You agree not to: misuse the Platform or interfere with its security or working; scrape, copy or resell our content or products for commercial purposes without permission; post unlawful, false, abusive or infringing content (including reviews); impersonate anyone; or misuse COD, refunds, coupons or customer support.

9. Reviews and content you share

If you post a review or other content, it must be honest and your own. You give us a non-exclusive, royalty-free right to display it on the Platform and our channels. We may remove content that breaches these Terms.

10. Intellectual property

All content on the Platform, including the EVRYDAY and WTF names and logos, designs, text, graphics, images and software, belongs to Witness the Fitness Pvt. Ltd. or its licensors. You may view it for personal, non-commercial use only.

11. Third-party services

The Platform uses third-party services such as payment gateways, courier partners, chat and analytics tools. Their own terms may apply, and we are not responsible for their independent acts.

12. Disclaimer and limitation of liability

  • The Platform is provided on an “as is” and “as available” basis. We do not promise that it will always be uninterrupted or error-free. Results from using supplements vary from person to person and are not guaranteed.
  • To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.
  • Nothing in these Terms limits liability that cannot be limited under law, or your rights under the Consumer Protection Act, 2019.

13. Indemnity

You agree to indemnify Witness the Fitness Pvt. Ltd. against claims and losses arising from your breach of these Terms or misuse of the Platform.

14. Communications

By placing an order or creating an account, you agree to receive order, delivery and service messages by SMS, email, phone and WhatsApp. You can opt out of promotional messages at any time; service messages about your orders will continue.

15. Suspension and termination

We may suspend or close access to the Platform for any user who breaches these Terms. You can stop using the Platform or ask us to close your account at any time.

16. Changes to these Terms

We may update these Terms from time to time. The updated version applies from the date it is posted. Orders already placed are governed by the Terms in force when you placed them.

17. Governing law and disputes

These Terms are governed by the laws of India. We encourage you to contact us first so we can resolve any issue. Subject to your rights as a consumer, courts at Gautam Buddh Nagar (Noida), Uttar Pradesh shall have jurisdiction.

18. Grievance redressal

We acknowledge grievances within 48 hours and aim to resolve them within 30 days of receipt.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to an affiliate or successor.
