Terms of Service

These Terms of Service (“Terms”) govern access to and use of wtfevryday.com, related customer-account features, applications, communications and services (collectively, the “Platform”), and purchases made through the Platform. The Platform and WTF EVRYDAY brand are operated by Witness the Fitness Pvt. Ltd., having its office at A Block, Sector 9, Noida, Uttar Pradesh 201301, India (“WTF EVRYDAY”, “Company”, “we”, “us” or “our”).
These Terms are an electronic record under the Information Technology Act, 2000 and applicable rules. They are generated electronically and do not require a physical or digital signature. By visiting the Platform, creating an account, placing an order, subscribing, booking a service, submitting content or otherwise using the Platform, you agree to these Terms and the policies incorporated by reference, including our Privacy Policy, Shipping Policy, and Cancellation, Return, Exchange, Replacement and Refund Policy.
If you do not agree, do not use the Platform or place an order. Nothing in these Terms limits a right or remedy that cannot lawfully be limited under applicable Indian law.
1. Eligibility and authority
- You must be at least 18 years old and competent to contract under Indian law to create an account or place an order. A minor may use the Platform only through and under the supervision of a parent or legal guardian who accepts responsibility for the transaction.
- If you use the Platform for a company, gym, institution or another person, you represent that you are authorised to bind that entity or person.
- Products marked for adults, specific age groups, athletes, pregnant persons or other defined populations must be purchased and used only in accordance with the label and applicable professional advice.
2. Nature of the Platform and seller identity
The Platform may operate in more than one capacity:
- WTF EVRYDAY as seller: Witness the Fitness Pvt. Ltd. or an affiliated authorised entity may sell or market its own products and may be identified on the product page, order confirmation or tax invoice.
- Marketplace or third-party seller: independent brands, manufacturers, distributors or sellers may offer products through the Platform. The applicable seller should be identified on the product page, order record or invoice.
- Services and integrations: third parties may provide payment, logistics, warranties, consultations, subscriptions, digital content, installation or other services.
Each seller is responsible for the accuracy, legality, safety, authenticity, quality, tax invoice, warranty and regulatory compliance of the goods it sells. Where WTF EVRYDAY acts as a marketplace facilitator, we may coordinate orders, payments, logistics and grievances but do not become the manufacturer of a third-party product merely by facilitating the transaction. This clause does not exclude any responsibility imposed on WTF EVRYDAY by law or any express promise made on the Platform.
3. Accounts and account security
- You must provide accurate, current and complete information and keep it updated.
- You are responsible for activity conducted through your account and for protecting passwords, one-time passwords and devices. Notify us promptly of suspected unauthorised access.
- You must not impersonate another person, create accounts using false information, use automated means to create accounts, or maintain accounts for fraudulent or abusive activity.
- We may verify identity, contact information, delivery details or transaction risk where reasonably required for fraud prevention, payment compliance, age restriction, warranty or legal obligations.
- We may suspend or close an account for verified fraud, abuse, security risk, unlawful conduct or material breach, after taking proportionate steps and subject to applicable law. Closing an account does not remove accrued payment, refund, warranty or grievance obligations.
4. Product information and availability
- We and sellers aim to present names, descriptions, images, colours, sizes, ingredients, nutritional information, specifications, compatibility, country of origin, seller details, price, tax, stock and delivery information accurately.
- Screen settings, packaging revisions, natural ingredients, manufacturing batches and supplier updates may cause reasonable visual or minor variations that do not materially change the product.
- The product label and package received should be read before use. If the product received materially differs from the listing, contact us before use.
- Availability shown online is not a guarantee until the order is accepted. Inventory may be corrected or withdrawn at any time.
- We may set reasonable purchase limits to manage scarcity, prevent resale abuse or comply with law.
5. Health supplements, nutraceuticals, food and wellness content
5.1 Product status
Unless expressly identified and lawfully approved otherwise, health supplements, nutraceuticals, protein products, vitamins, minerals and functional foods sold through the Platform are foods intended to supplement a normal diet. They are not medicines and are not intended to diagnose, treat, cure, mitigate or prevent disease.
5.2 Safe use
- Read the ingredient list, nutrition information, allergens, serving size, recommended usage, duration, contraindications, storage instructions, age guidance and warnings before purchase and use.
- Do not exceed the recommended usage. Supplements are not substitutes for a varied diet, balanced lifestyle or prescribed treatment.
- Consult a qualified healthcare professional before use if you are pregnant or nursing, under 18, elderly, under medical supervision, taking medication, have allergies or a medical condition, are preparing for surgery, or are purchasing for a child.
- Individual responses vary. Testimonials, reviews and general educational content do not guarantee a particular outcome.
- Stop use and seek appropriate professional advice if an adverse reaction occurs. Report suspected quality or safety issues with the product name, batch number and relevant details.
5.3 Information and claims
Nutrition, fitness and wellness content is provided for general educational purposes and is not medical diagnosis, prescription, emergency advice or a substitute for consultation with a qualified professional. Where Website content conflicts with the final lawful product label, contact us before use. We and sellers must not make prohibited disease-treatment claims, and users must not interpret general structure-function or wellbeing statements as medical promises.
6. Other product categories
- Apparel and footwear: consult the size guide and product-care information. Fit can vary by design and manufacturer.
- Fitness equipment and accessories: follow assembly, weight-limit, safety, maintenance and supervision instructions. Inspect equipment before each use and stop use if damaged.
- Electronics and connected devices: check compatibility, electrical requirements, app availability, warranty and data practices before purchase. Health or fitness measurements from consumer devices are not medical diagnoses unless expressly certified and represented as such.
- Cosmetics and personal care: review ingredients and warnings, patch-test where appropriate, avoid use on damaged skin unless directed, and discontinue use if irritation occurs.
- Personalised products: you are responsible for checking names, sizes, artwork and other approved specifications before production begins.
7. Orders and contract formation
- Products placed in a cart are not reserved. An order submission is an offer to purchase.
- An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance. The order is accepted when the seller confirms it, dispatches the product, begins an agreed service, or otherwise communicates acceptance.
- We or the seller may reject or cancel an order for stock unavailability, payment failure, suspected fraud, regulatory restrictions, listing or pricing error, serviceability failure, incomplete information or another legitimate reason.
- If only part of an order is accepted, the remaining part may be cancelled and the corresponding amount refunded.
- You must review product, variant, quantity, address, phone number, price, tax, fees and payment method before submitting the order.
8. Prices, taxes, promotions and errors
- Prices are displayed in Indian rupees unless stated otherwise. Applicable taxes, shipping, COD and other charges are shown before order completion where required.
- MRP, selling price and discounts may differ across sellers, channels, locations and time periods, subject to law.
- Coupon codes, loyalty benefits, referrals and promotions are subject to their stated eligibility, validity, exclusions, usage limits and anti-abuse conditions.
- Promotions cannot be combined unless expressly permitted. A benefit obtained through fraud, automation, duplicate accounts or manipulation may be cancelled after reasonable verification.
- If a price, discount, tax or product description contains an obvious or material error, we may contact you for approval of the correct terms or cancel and refund the affected item. We will not dispatch a materially changed order without consent.
9. Payments and fraud prevention
- Payments may be processed by third-party payment providers. Their applicable terms and security procedures may apply.
- You represent that you are authorised to use the payment instrument and that transaction information is accurate.
- We do not ask for a card PIN, UPI PIN, password or OTP to process a refund. Do not share these credentials.
- An order may be held or cancelled where payment is not authorised, is reversed, is disputed, or is flagged by reasonable fraud or compliance controls.
- Bank offers, wallet benefits, EMI, pay-later products and card promotions may be governed by the issuer or provider. We are not responsible for a provider’s independent eligibility decision, while remaining responsible for our own representations and obligations.
10. Cash on delivery
- COD availability may depend on product, order value, seller, postcode, customer history and logistics serviceability.
- We may request order confirmation or partial advance payment for high-value, customised, bulky or risk-flagged orders where disclosed before dispatch.
- Repeated unjustified refusal or abusive COD activity may lead to reasonable restriction of COD access. This does not affect a customer’s right to refuse visibly damaged, tampered, incorrect or materially delayed goods.
11. Shipping, delivery and title
Processing, delivery estimates, shipping charges, tracking, failed delivery and related matters are governed by the Shipping Policy. Delivery dates are estimates unless expressly guaranteed. Risk and title pass as provided by applicable law and the relevant seller arrangement. You should inspect packaging on delivery and promptly report visible damage, tampering, wrong supply or missing items.
12. Cancellation, returns, exchanges, replacement and refunds
Eligibility and process are governed by our published Cancellation, Return, Exchange, Replacement and Refund Policy and any product-specific terms disclosed before purchase. Consumables and hygiene-sensitive products have stricter preference-return rules, while defective, deficient, unsafe, spurious, expired, wrong, misdescribed or materially delayed goods remain subject to applicable consumer rights. Store credit will not be forced where a monetary refund is legally due.
13. Warranties
- A product may carry a manufacturer or seller warranty stated on the listing or package. Keep the invoice, serial number and warranty documents.
- Warranty coverage, duration and exclusions differ by product. Normal wear, misuse, unauthorised alteration, accidental damage and failure to follow instructions may be excluded where lawfully stated.
- No statement by support personnel expands a written warranty unless confirmed by an authorised representative.
- Manufacturer-warranty procedures do not remove a remedy owed by a seller or platform under applicable consumer law.
14. Subscriptions, memberships and recurring orders
- Before enrolment, the Platform should disclose the recurring price, billing interval, included benefits, trial period if any, renewal method and cancellation process.
- By choosing a recurring plan, you authorise charges at the stated interval until cancellation or expiry.
- You must cancel before the displayed cut-off to prevent the next billing or order. Cancellation stops future renewals; it does not automatically refund a period already started or an order already processed.
- We will not add a paid subscription or materially increase recurring charges without disclosure and any consent required by law.
- Benefits may be personal, non-transferable and subject to fair-use limits disclosed at enrolment. Material reductions to prepaid benefits will be addressed fairly, including appropriate adjustment or cancellation rights where required.
15. Digital content, consultations and services
- Access requirements, booking rules, duration, scope, deliverables and cancellation terms should be disclosed before purchase.
- Digital access, coaching, nutrition guidance, fitness programming and consultations are educational or general wellness services unless expressly stated otherwise. They are not emergency, diagnostic or medical treatment services.
- You remain responsible for obtaining medical clearance and exercising safely. Stop an activity if pain, dizziness or concerning symptoms occur and seek appropriate professional advice.
- Services may be delivered by independent professionals. Their credentials and service terms should be disclosed where relevant.
- Recording, reselling or distributing paid sessions or digital materials without permission is prohibited.
16. User reviews, questions and other content
- You retain ownership of original content you submit, but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, moderate and display it for operating and promoting the Platform and products, subject to our Privacy Policy.
- You represent that your content is truthful, based on genuine experience, and does not infringe rights, disclose confidential or personal information, contain unlawful claims, or mislead consumers.
- Do not submit fabricated reviews, undisclosed paid endorsements, prohibited medical claims, harassment, hate speech, malware, spam or illegal content.
- We may moderate or remove content for legitimate policy, safety or legal reasons, but will not manipulate reviews to misrepresent overall consumer opinion.
- If an incentive is offered for a review, it must not depend on the review being positive and should be disclosed as required.
17. Intellectual property
The Platform, WTF EVRYDAY name and logos, design, software, text, graphics, photographs, videos, databases, product presentation and other content are owned by or licensed to the relevant rights holder and protected by law. You may access them for personal, non-commercial use. Without permission, you must not copy, scrape, reproduce, modify, translate, distribute, sell, reverse engineer, frame, mirror, create derivative works from, or use content or trademarks in a way that suggests endorsement. Rights in third-party brands and seller content remain with their owners.
18. Acceptable use
You must not:
- use the Platform for unlawful, fraudulent, harmful or deceptive activity;
- interfere with security, availability, checkout, pricing, inventory, reviews or another user’s access;
- introduce malware, attempt unauthorised access, probe vulnerabilities or circumvent technical limits;
- use bots or scraping tools contrary to applicable law or written permission;
- resell products where prohibited, remove traceability information, or distribute suspected counterfeit, expired or tampered goods;
- misuse refund, referral, loyalty, COD, promotion or grievance processes; or
- submit content that infringes intellectual property, privacy, publicity or other legal rights.
19. Third-party links, tools and services
The Platform may link to or integrate services operated by payment providers, logistics companies, social networks, analytics providers, warranty partners and other third parties. Their services may be governed by separate terms and privacy notices. A link does not by itself constitute endorsement. We are responsible for our own choices and representations but are not responsible for an independent third party’s service beyond the extent required by law or an express commitment.
20. Privacy and communications
Our collection and use of personal information is described in the Privacy Policy. Transactional communications about orders, payments, delivery, support, safety, recalls and account security may be sent by email, SMS, phone, WhatsApp or another channel reasonably connected to the transaction. Marketing communications are subject to applicable consent and opt-out requirements. Withdrawing marketing consent does not prevent necessary transactional or legal communications.
21. Product recalls and safety action
If a product is recalled or presents a credible safety concern, we or the responsible seller or manufacturer may contact customers, suspend sales, request discontinuation of use, arrange return, replacement or refund, and share information with competent authorities as required. Customers should cooperate with reasonable traceability and safety instructions.
22. Disclaimers and consumer guarantees
To the maximum extent permitted by law, the Platform may experience interruptions, maintenance, external network failures or minor errors, and we do not guarantee uninterrupted access. However, nothing in these Terms excludes statutory guarantees, liability for defective products, fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any duty that cannot legally be excluded.
No clause stating that a service is provided “as is” removes a consumer’s right to receive goods and services that conform to their description, applicable safety and quality standards, and express promises.
23. Limitation of liability
Subject to the paragraph below and applicable law, neither party is liable to the other for indirect or consequential commercial loss that was not reasonably foreseeable from the transaction. Any contractual limitation will be interpreted narrowly and proportionately.
No limitation applies where prohibited by law, including liability arising from fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, defective products where statutory liability applies, breach of privacy or data-security duties, infringement of intellectual property, or failure to provide a mandatory consumer remedy.
24. Indemnity
You agree to be responsible for direct loss reasonably caused by your unlawful use of the Platform, fraud, infringement of third-party rights, or material breach of these Terms. This obligation will not make a consumer liable for our or a seller’s own negligence, legal breach or defective product, and will be applied only to the extent permitted by law.
25. Force majeure
A party is not responsible for delay caused by events beyond reasonable control, including natural disaster, epidemic, government restriction, war, civil disturbance, major infrastructure or carrier disruption, or similar event, provided reasonable mitigation and communication occur. Force majeure does not permit retention of payment indefinitely where the order cannot be fulfilled; an appropriate cancellation, rescheduling or refund remedy will be provided as required by law.
26. Suspension, termination and survival
You may stop using the Platform at any time. We may suspend or terminate access for material breach, security threat, fraud or unlawful conduct using proportionate measures. Terms that by nature should survive—including payment obligations, intellectual property, warranties, dispute rights, liability provisions and accrued consumer remedies—continue after termination.
27. Changes to the Platform and Terms
We may update the Platform and these Terms for legal, security, product or operational reasons. The version accepted or made available at the time of a transaction ordinarily governs that transaction. Material changes will not be applied retrospectively to reduce an accrued consumer right. Continued use after prospective changes take effect constitutes acceptance only to the extent permitted by law.
28. Governing law and disputes
These Terms are governed by the laws of India. The parties should first attempt good-faith resolution through customer support and grievance redressal. Nothing in these Terms restricts a consumer from approaching the National Consumer Helpline, a consumer dispute redressal commission, regulator, court or other forum having jurisdiction under applicable law. Any business-to-business dispute not subject to mandatory consumer jurisdiction may be brought before the competent courts at Noida, Uttar Pradesh, unless otherwise agreed in writing.
29. Severability, waiver and assignment
- If a provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remainder will continue.
- A delay in enforcing a right is not a waiver.
- You may not transfer contractual rights or obligations without consent where the transfer would affect performance. We may transfer the business or contract as part of a lawful merger, restructuring or asset transfer, subject to notice and preservation of consumer rights.
30. Entire agreement and priority
These Terms, the order details, product-page disclosures and incorporated policies form the agreement for Platform use and purchases. If terms conflict, mandatory law prevails, followed by a specific written promise made for the order, then product-specific terms, then the applicable policy, and then these general Terms. A more customer-favourable express promise will be honoured.
